Driven to Distraction

The good news is that New York officials have devised a potential method to determine whether a driver was distracted by his or her mobile phone at the time of a collision. The application, called the Texalyzer, would allow law enforcement officers access to the drivers’ operating systems to uncover what, if anything, was happening during the crash. Opponents have voiced privacy concerns with the application, and it's unclear whether this will become the norm. The most important thing is that city officials are taking (or at least appear to be taking) this problem seriously.

A Look at Auto Accidents

As a team of expert personal injury attorneys, we try to stay on top of the news in the field. Recently, we read that Google has filed a patent for a unique automotive augmentation - a "sticky" adhesive coating that would take pedestrians along with the car in the event of an accident. It sounds a bit like something from a video game or a sci-fi movie, but the schematics are interesting. The premise is that, if one of Google's self-driving vehicles were to accidentally strike a pedestrian, the coating on the car's hood would "trap" the person like flypaper. So, instead of incurring additional injuries from being sent skyward or being rolled over, the unlucky individual will just be stuck on the car's hood like a fried egg.

Seriously, though, it's clear that Google has put a lot of thought into this idea, and it seems that it may actually reduce the severity of vehicle-related personal injury in the event of an accident. Of course, there's still a long way to go until these self-driving cars become a common phenomenon on our roads. But that being said, considering that the major causes of auto accidents stem from dangerous human behavior (intoxication and distraction), it may be worthwhile to place our faith in finely tuned machines and super-precise navigation systems. It Can Wait

As a group of dedicated vehicle accident lawyers, we make our best effort to follow the newsreels. We've heard about a recent case involving an 18-year-old girl who was using the smartphone application Snapchat to take a video of herself driving at speeds exceeding 100 miles per hour. While we're not yet certain as to how the legal case will pan out, we can say that an auto accident occurred that has resulted in a critical brain trauma of the driver whose car the teen rear-ended. Complicating matters, the victim is suing Snapchat and claiming that the application's "speed filter" feature, which tracks how fast someone is traveling while they take a selfie, encourages users to Snap while driving, despite the fact that the app advises users to 'NOT Snap and Drive.'

Obviously, as personal injury attorneys, we sincerely do not anyone, especially very young drivers who seem to be attached to these social apps, to use them while driving under any circumstances. Because approximately 26% of auto accidents involve a distracted driver, a great many injuries and even untimely deaths can be prevented if we manage to eliminate these distractions. Ready for the Unexpected?

As we write this, something very unusual is happening in Los Angeles. Yes, we're having a rain storm...in May! That's at least some very minor good news for our ongoing drought situation. However, if you're a vehicle accident lawyer, your first thought it going to be about an inevitably higher risk of traffic accidents caused by suddenly slippery streets and highways.

Don't worry, however, we're not here to remind you, yet again, to slow down when you're driving in the rain (though that's definitely essential advice). Transforming Transportation

Any vehicle accident lawyer has to pay attention to the headlines. Currently, the CEO of L.A.'s Metropolitan Transportation Authority has unveiled a $120 billion plan that seeks to fund numerous public transit and highway projects for the next 15 years. The plan necessitates increasing the countywide sales tax by a half cent and maintaining the existing sales tax rate for the next 18 years. In November, L.A. County residents will vote on the measure - they'll need board support to reach the two-thirds threshold required to put the project into progress.

We certainly hope that this may lead to a reduction in traffic and road related personal injury cases. As it stands, tens of thousands of road fatalities occur each year. Looking forward to 2020 and beyond, we should expect this number to drop due to an influx of self-driving cars and better-coordinated and organized transportation systems, but we can never be too certain. Sure, L.A. has seen its fair share of light rail-related mishaps, but they pale in comparison to those that occur on the highways and major streets.

Drive Peacefully!

A news story about an incident that started as a relatively minor automotive collision and ended in a stabbing got us thinking about the very real dangers of road rage. Fortunately, the man who was stabbed did not appear to suffer a truly life-threatening injury, but as personal injury attorneys, we've certainly seen less dramatic incidents result in more tragic outcomes.

The scary part is that road rage is extremely common. Indeed, if we're being honest, most of us have probably let our tempers get the best of us in traffic. Making it to the Slopes

Southern California might be known around the world as one of the sunniest places on earth, but our mountains are havens for winter sports enthusiasts. An Increasingly Automated World

While considering the plethora of modern conveniences at our disposal, it's natural to look to the future with a profound sense of optimism. Many people are looking forward to the day they can enjoy the comfort of commuting and going on road trips without having to get behind the wheel, and news stories create the idea that this will become a reality sooner and sooner.

Despite having an otherwise stellar safety record, one of Google's self-driving vehicles struck a public bus recently in Mountain View, CA. Ridesharing Safety

No one can deny the recent influence that ride sharing apps are having on the world of transportation. While services like Uber were originally branded controversial as they allegedly threatened the livelihood of city taxi drivers, these mobile app services remain, for most people, a standard budget conscious alternative form of transportation.

In the wake of a fatal shooting by an Uber driver in Kalamazoo, officials are considering increased vetting processes to reduce the chance of this reoccurring. But Uber claims that the shooter had passed a background check and had no prior criminal record, although the man violated the company's "no firearm" policy. Workplace Safety in the Fantasy Business

There's no getting around it, although the entertainment business is, indeed, a very large and very serious business, it's also a business that's all about the production of fantasy. So, it's always a bit jarring when something as nonfantastical as personal injury and workplace safety law finds its way into the entertainment headlines. That's exactly what happened late last week, however, as news broke that the British government is prosecuting Foodles Production (UK) Ltd. over an incident that broke the leg of actor Harrison Ford on the set of the megahit "Star Wars" installment, "The Force Awakens."

While there doesn't appear any high profile legal action involving personal injury attorneys between Ford, who was 71 at the time of the 2014 incident, and the "Star Wars" team, the UK government takes workplace safety issues seriously. In this case, the issue was a hydraulic door that apparently closed at the wrong time, and the hazard posed by this kind of malfunction is obvious. As underscored by such incidents as the tragedy on the set of the never-to-be-completed "Midnight Rider" -- which coincidentally occurred two years ago almost to this day -- the stakes in workplace safety on a film or television set really can be a matter of life or death.

Legislation and Road Safety

There's been a lot of talk about proposed seat belt and motorcycle helmet laws in Missouri, and it's created a healthy amount of discussion. Ultimately, politicians and lawmakers are an an impasse when it comes to the question: is it the government's job to enforce seat belt and helmet usage, or the role of the individual? Naturally, as a Los Angeles personal injury attorney, we encourage drivers and cyclists to take every possible precaution on the roads to reduce the impact of personal injury should an accident occur.

It would be natural to assume everyone acts in accordance with this idea, but it's unfortunately not true. According to the National Highway Traffic Safety Administration, the national rate of seat belt usage stands at 87 percent, while in Missouri it's at 79 percent and trending downward. One reason behind this factor may be that adults who sit in the backseat of vehicles are exempt from seat belt requirements. In order to boost seat belt compliance, lawmakers are considering making it a crime not to wear a seat belt, which would give police officers the authority to pull over more drivers and cite them.

Only time will tell to see if these measures or education campaigns will be effective in boosting seat belt compliance. The Danger of Unsecured Firearms

A recent article sheds light on the tragic story of a four-year-old Maryland boy who fatally shot himself after discovering a loaded firearm in the home. While in Maryland, it is technically a crime to store or leave a loaded firearm in a location where an unsupervised child can gain access to it, it is virtually unenforceable. Nonetheless, for parents who have lost a child in this way, a $1000 fine and misdemeanor charge is essentially irrelevant.

It seems that the solution to preventing personal injury with firearms lies in gun safety training, proper gun storage, and potentially, smart gun technology. For the latter, a significant amount of backlash has been noted in response to state lawmakers proposing smart gun legislation. Some of these reasons include it being a relatively new technological innovation still undergoing testing. And while some Los Angeles personal injury attorneys believe that smart gun technology will prevent accidental firings, others are cautious; holding the belief that such technology will impede on citizens' right to bear arms.

Only time will tell which methods are most successful at preventing accidental injury. But unless some measures are taken, such tragedies will continue to occur. The Future of Personal Injury

While browsing the web, we came across a particularly interesting recent article that begs the question, does damage to prosthetic limbs count as personal injury or property damage? According to the law, you and your cell phone are two separate entities, but as integration between humans and machines becomes closer, will new laws be put into place that reflect this? As personal injury attorneys we do a great deal of work in this field, so we are especially curious to see what may develop further down the road.

However, according to the article, today’s prostheses are becoming increasingly integrated with the body and can even be activated by electrical signals from muscles, so at what point may they be considered as inseparable from the body itself? It leaves us to wonder: in the case of a car accident where a prosthetic limb is damaged, could that be seen as a case of personal injury, or simply damaged equipment? Especially considering cases of mobility, as with the prosthetic legs in the attached image, the damage can be perceived as much more "personal" than when, say, a person's smart phone is damaged.

Nonetheless, the jury's out as to whether personal injury laws will change in relation to this matter in the near future.

Now that the holidays are over, we're going to hear slightly less about the dangers of drunk driving. While that may be somewhat inevitable, anyone who's worked as, or with, a vehicle accident lawyer knows that these kind of accidents happen seven days a week, 365 days a year.

We were thinking about this while reading about the tragic case of 21 year-old Lyft driver Thor Anderson, who was killed in Hawthorne at roughly 3:00 in the morning on New Year's Day in an accident involving another driver of the same age. A DUI is suspected in the case. The young driver's father said that he was working for Lyft to help his family and was excited about the money he could make by working on New Year's Eve.

Personal injury attorneys see these kind of cases more than anyone would like to, and they happen every day. However, that doesn't mean we aren't moved by the loss of families impacted by this type of tragic DUI accident. Indeed, the devastation in these cases can be overwhelming at times. Oftentimes, the saddest realization of all is how easily they could have been prevented. In this case, ironically, all it might have taken to save Thor Anderson's life was one more call to Lyft or Uber on the part of the other driver in the case.
