Why We're Needed

Every now and then we'll hear talk from politicians about the evils of trial lawyers, especially the kind who might work at a personal injury law firm. Let's face it, bashing lawyers is literally as old as quoting William Shakespeare out of context. (The character who uttered the line  "First thing we do, let's kill all the lawyers" in Henry VI was a villain and up to no good.)

The fact of the matter is that politicians who say this are, not surprisingly, politically motivated -- we're a popular target -- but they are also doing the bidding of their extremely wealthy corporate contributors. The fact of the matter is that, very often, a personal injury or product liability lawyer is the only check on large corporations who unknowingly through incompetence, but also knowingly through greed, complacency, and callous disregard for human life, endanger the public and end up being responsible for deaths or injuries.

If you don't believe that any corporate player would ever do anything that they know for a fact will likely kill or maim members of the public, we only need to draw your attention to the recent testimony of General Motors CEO Mary Barra. The executive was forced to confront evidence that a past GM administration had chosen not to replace a part costing all of 57 cents because there was no "acceptable business case" for doing so. In other words, they did not believe that a large number of probable deaths and injuries would cost enough money for a recall to make financial sense.

So, it appears, the problem is not that trial lawyers like us are obtaining too much money in frivolous court cases, but are not obtaining nearly enough in cases that are as serious as dying in an unnecessary auto accident! The next time you hear a politician talk about so-called tort reform, therefore, perhaps you should write him or her and suggest that the reform might be in the direction of making it easier to bring cases against bad actors, not harder.
