After an Accident, Stay Calm and Gather Evidence

  • Taking pictures is key. The more pictures, the better, especially if your pictures can include landmarks or addresses to help place the scene.
  • Talk to witnesses. Get their contact information and phone numbers.
  • Swap insurance information with the other person. Be pleasant, but don't talk too much. Never admit fault, even if you think it was your fault (it might not be!). 
  • Write down everything you remember the other person saying. Do not secretly record audio of the conversation, however, without their permission as it's a crime and generally not admissible in court.
  • If the other person makes you an offer for a settlement on the spot, get it in writing. Do not take their word.
