The good news is that New York officials have devised a potential method to determine whether a driver was distracted by his or her mobile phone at the time of a collision. The application, called the Texalyzer, would allow law enforcement officers access to the drivers’ operating systems to uncover what, if anything, was happening during the crash. Opponents have voiced privacy concerns with the application, and it's unclear whether this will become the norm. The most important thing is that city officials are taking (or at least appear to be taking) this problem seriously.

It Can Wait

As a group of dedicated vehicle accident lawyers, we make our best effort to follow the newsreels. We've heard about a recent case involving an 18-year-old girl who was using the smartphone application Snapchat to take a video of herself driving at speeds exceeding 100 miles per hour. While we're not yet certain as to how the legal case will pan out, we can say that an auto accident occurred that has resulted in a critical brain trauma of the driver whose car the teen rear-ended. Complicating matters, the victim is suing Snapchat and claiming that the application's "speed filter" feature, which tracks how fast someone is traveling while they take a selfie, encourages users to Snap while driving, despite the fact that the app advises users to 'NOT Snap and Drive.'

Obviously, as personal injury attorneys, we sincerely do not anyone, especially very young drivers who seem to be attached to these social apps, to use them while driving under any circumstances. Because approximately 26% of auto accidents involve a distracted driver, a great many injuries and even untimely deaths can be prevented if we manage to eliminate these distractions. It's Okay to be Scared!

Last week, we gave you some safety tips for Halloween, but now it's time to get a little bit more basic. After all, this holiday is a celebration of fear, and that's a good things as it tends to get a bit of bad rap the rest of the time. In any case, it's a good time to look at the upside of being afraid.

Celebrate & Keep Safe on July 4th

We love holidays here a the Law Offices of Burg & Brock, who doesn't? We get a 3-day weekend this Independence Day filled with barbeques and a firework display on the beach. Making the L.A. River Beautiful - and Safe

One of the major stories for the growing number of L.A. cyclists these days is the Los Angeles River renovation project, which involves the extending of bike paths  northwest from Riverside Drive to Lankershim Boulevard by 2016 - allowing cyclists to enjoy 35 miles of continuous bikeway! It's an ambitious project that could offer terrific fun for cycling enthusiasts looking to enjoy the great outdoors - but it's one that also brings with it a number of challenges - not the least of which is ensuring safety for riders.


This was made clear in one recent City Council proposal, in which it was agreed to explore the building of access ramps allowing cyclists to access downtown from the bike paths - despite concern about heightened injury risk and maintenance costs. Yuval Bar-Zemer, a board member of Friends of the Los Angeles River, said that the organization would make sure the area was as safe as possible.
